When to make a Compensation Claim

If you are thinking of making a compensation claim then make sure that you do not do it too early, it could mean that you miss out of tens of thousands of pounds of compensation. However, if you leave things too late, you may get nothing at all.

Most cases have three years after the day of the accident (or in some cases the diagnosis) for a claim to be made. After that, they will miss their opportunity. This means that there is a temptation to make a claim as soon as possible, but this is not always the best approach.

Once you are fully recovered from your injury then it is advisable to start proceedings as quickly as possible. If you are not fully recovered it could be better to wait. Your solicitor may try to hurry you along, however, there is no need to hurry unless you are coming up close to your three year deadline.

If you make a claim before you have recovered then you could miss out on money. This is because your compensation is calculated on the severity of the injury and if you are not recovered they will only be able to judge it based on how long it has latest so far rather than how long it lasted in total. However, if you will never recover, then this will be a different thing as you will get payments for the future as well as the past. If you are off work and having to pay out for medication or other treatment, then you can claim costs for these things. If you are not fully recovered then there will be costs in the future for these things and you will not be able to claim for them because you have already been awarded your compensation.
